Thus, it is my responsibility to use diligence in tracking the status of my account(s) and orders at all times to assure no unexpected results occur. By using the beta-phase software, I accept all risks involved at all times and if at any point I decide not to accept these risks, I agree to immediately discontinue use of the software.

I explicitly agree to hold harmless Chart Dynamix LLC, NinjaTrader LLC and any of its third-party affiliates from any liability arising from the use of its software. This includes but is not limited to claims, lawsuits, demands, causes of action, liability, monetary loss, property damage, software corruption, hardware damage, loss of time or implied-value assets, or other damages of any kind whatsoever.
